Comelec Halts Preparations for Bangsamoro Elections Following Supreme Court’s TRO

Manila: The Commission on Elections (Comelec) on Wednesday ordered the suspension of preparations for the Bangsamoro Autonomous Region in Muslim Mindanao (BARMM) Parliamentary Elections set on October 13, following a temporary restraining order issued by the Supreme Court against the implementation of Bangsamoro Autonomy Act 77.

According to Philippines News Agency, Comelec Chairperson George Garcia stated in a press briefing that the commission en banc's decision to halt all preparations complies with the Supreme Court's ruling. Garcia emphasized that all election-related activities will remain suspended until the TRO is lifted or a final ruling is made by the Court regarding the legality and constitutionality of Bangsamoro Autonomy Act No. 77.

Garcia warned that the Comelec could face contempt charges if it continued with the preparations. When questioned about the likelihood of the elections occurring next month, Garcia explained that due to the suspension, Comelec is unable to confirm if the elections will proceed as scheduled on October 13.

BAA 77, also known as the Bangsamoro Parliamentary Act of 2025, amended BAA 58, which was an act for creating parliamentary districts in BARMM. BAA 77 reallocated seven parliamentary districts initially assigned to Sulu, whereas BAA 58 excluded Sulu from the BARMM. Garcia clarified that the TRO does not render BAA 58 revived or nullify BAA 77; it merely pauses the implementation of the act while its legality is reviewed.

Garcia mentioned that Comelec is preparing to submit a manifestation to the Supreme Court on Thursday, with a formal response to the ruling expected early next week. He instructed the law department to work with the Office of the Solicitor General to ensure compliance with the TRO by suspending preparations for the October 13 elections. The upcoming manifestation aims to clarify the actions required by Comelec, given the repeal of BAA 58.
