Manila: Government prosecutors have announced plans to file a formal comment on Vice President Sara Duterte's motion to quash grave threats charges lodged by the Department of Justice (DOJ) at the Quezon City Regional Trial Court (RTC). In a recent press briefing, Chief State Prosecutor Richard Anthony Fadullon stated that they are awaiting a formal order from the RTC to proceed with the comment on the motion submitted by Duterte's defense team.

According to Philippines News Agency, the court has already received the motion to quash from the defense, and the prosecution has been allotted five days to file its comment before the court resolves the issue. Fadullon expressed readiness to comply with the court's order, expecting to receive it by the end of the week, and assured that their comment will be filed promptly.

Attorney Paul Lim, representing Vice President Duterte in the grave threats case, confirmed the submission of a motion to quash the charges on the basis of lack of jurisdiction. Lim emphasized adherence to professional responsibility and declined further discussion due to the sub judice nature of the case.

Fadullon clarified that the resolution of the charges against Duterte, who allegedly threatened President Ferdinand R. Marcos Jr., First Lady Liza Araneta-Marcos, and former House Speaker Martin Romualdez, will rest with the RTC. He noted that the RTC proceedings are distinct from any impeachment processes, and reaffirmed the prosecution's right to file charges against impeachable officers.
