Manila: The Department of Labor and Employment (DOLE) on Saturday reminded private sector companies about the appropriate pay rules for Ninoy Aquino Day, a special non-working day on August 21, and National Heroes Day, a regular holiday on August 31.

According to Philippines News Agency, Labor Advisory 31 specifies that employees who work on a regular holiday are entitled to receive 200 percent or double their daily rate. If an employee does not work on the regular holiday, they will still receive 100 percent of their salary for that day, provided they work or are on leave with pay on the day immediately before the holiday. If the day before the holiday is a non-working day or a rest day, employees will still receive holiday pay if they work or are on leave with pay the day prior to the non-working day or rest day.

For overtime work on a regular holiday, employers must pay an additional 30 percent of the hourly rate. If the holiday coincides with a rest day, employees receive an additional 30 percent of their basic wage. Overtime work on such a day requires an additional 30 percent of the hourly rate as well.

The DOLE also reiterated the 'no work, no pay' principle for August 21, unless a company policy, practice, or collective bargaining agreement states otherwise. Employees working on this special day are entitled to an additional 30 percent of their basic wage for the first eight hours. For overtime, an additional 30 percent of the hourly rate applies.

For work done on a special day that is also a rest day, employees are entitled to an additional 50 percent of their basic wage for the first eight hours. Overtime work on such a day warrants an additional 30 percent of the hourly rate.
