Manila: Private sector employees who report for work on Monday, December 8, declared a special non-working day in observance of the Feast of the Immaculate Conception, are entitled to receive additional pay, the Department of Labor and Employment (DOLE) said.
According to Philippines News Agency, in Labor Advisory No. 17, DOLE stated that employees working on this special day must be compensated at 130 percent of their basic wage for the first eight hours, calculated as Basic wage. For those who do not work, the ‘no work, no pay’ rule will apply unless their company policy provides payment on special days.
Furthermore, workers who perform overtime should receive an additional 30 percent of their hourly rate for any hours worked beyond eight. If an employee’s workday coincides with their scheduled rest day, they are entitled to 150 percent of their basic wage for the first eight hours, calculated as Basic wage. Overtime on a rest day will be remunerated at an added 30 percent of the hourly rate, calculated as Hourly rate number of hours worked.
December 8 is a nationwide special nonworking holiday to honor the Feast of the Immaculate Conception of Mary, the principal patroness of the Philippines. This was established through Republic Act 10966, signed on December 28, 2017.
