DOLE Clarifies ‘No Work, No Pay’ Policy for Chinese New Year

Manila: Private sector employees not working on Wednesday, a special non-working day in celebration of Chinese New Year, will be unpaid. The Department of Labor and Employment (DOLE), in an advisory Tuesday, stated that the 'no work, no pay' principle will apply based on the pay rules it has issued.

According to Philippines News Agency, the DOLE advisory specified that if the employee does not work, the "no work, no pay" principle shall apply unless there is a favorable company policy, practice, or collective bargaining agreement (CB) granting payment on a special day. For those who will be present at work on January 29, the employer is required to pay the employee an additional 30 percent of the basic wage for the first eight hours of work.

The advisory further explains that for work performed in excess of eight hours, the employee shall receive an additional 30 percent of the hourly rate on that day. If the employee reports to work during the special day that also coincides with their rest day, the employer shall pay the employee an additional 50 percent of the basic wage for the first eight hours of work.

For any work performed in excess of eight hours during the special day that also falls on the employee's rest day, the employer shall pay the employee an additional 30 percent of the hourly rate on that day.
