Manila: The Department of Labor and Employment-Bureau of Working Conditions (DOLE-BWC) on Monday reminded business establishments that they may suspend work during weather disturbances and similar occurrences, to ensure the safety and health of employees.
According to Philippines News Agency, the DOLE-BWC highlighted this in a social media post, referencing Labor Advisory No. 17 Series of 2022, 'Suspension of Work in the Private Sector by Reason of Weather Disturbances and Similar Occurrences.' The advisory states that employers in the private sector can exercise management prerogative, in coordination with the safety and health committee or responsible company officer, to suspend work during such events.
The advisory also addressed the payment of wages for employees who do not report to work due to suspended operations. It clarified that employees are not entitled to regular pay if they do not work, except when company policies or agreements allow payment on such days or when employees use accrued leave credits.
For those who do work, the advisory ensures full regular pay for employees working at least six hours. Those working less than six hours are entitled to a proportionate amount of regular pay, subject to more favorable company policies or practices.
Additionally, the DOLE emphasized that employees who fail or refuse to work due to imminent danger from weather disturbances will not face administrative sanctions. In a related development, the Palace has approved the suspension of classes at all levels and work in government offices in Metro Manila and nearby provinces due to heavy rains caused by the southwest monsoon.
