Manila: The Supreme Court (SC) has ordered respondents to file comments in the petitions challenging Republic Act (RA) 12232, which reschedules the Barangay and Sangguniang Kabataan (SK) Elections from December 1, 2025, to the first Monday of November 2026.
According to Philippines News Agency, SC spokesperson Camille Ting informed reporters that the court has not issued any temporary restraining order (TRO) at this time. The SC en banc examined three petitions on August 19 and 28, deciding to consolidate them into a single case.
The court has also instructed parties to submit comments on the petition-in-intervention filed by the Liga ng Barangay (League of Barangays) and 51 village chiefs. This petition requests the court to uphold RA 12232, asserting that it was enacted within Congress's constitutional powers. The group contends that RA 12232 establishes and extends the terms of Barangay and SK officials, a legislative power.
They argue that RA 12232 differs from RA 11935, which only postponed the December 2022 BSKE and was deemed unconstitutional by the court. President Ferdinand R. Marcos Jr. previously stated that rescheduling the BSKE would enable the Commission on Elections to concentrate on the inaugural Bangsamoro Autonomous Region in Muslim Mindanao parliamentary elections on October 13.
