Manila: Private sector employees who do not report to work on Thursday, a special non-working day in observance of Ninoy Aquino Day, will not receive their salary for the day, the Department of Labor and Employment (DOLE) has announced.
According to Philippines News Agency, DOLE issued Labor Advisory No. 11, which outlines the enforcement of the "no work, no pay" principle on August 21, 2025. The advisory states that unless a company has a favorable policy, practice, or a collective bargaining agreement (CBA) in place that provides payment for a special working day, employees who do not work will not be paid.
Employees who do report to work on Ninoy Aquino Day will be entitled to additional compensation. They will receive an extra 30% of their basic wage for the first eight hours of work, calculated as Basic wage x 130 percent. For any work done beyond eight hours, employees are entitled to an additional 30% of their hourly rate, calculated as Hourly rate of the basic wage x 130 percent x 130 percent x number of hours worked.
If the special day coincides with an employee's rest day and they work, the employer is required to pay an additional 50% of the basic wage for the first eight hours, calculated as Basic wage x 150 percent. For work done in excess of eight hours on such a day, employees will receive an additional 30% of the hourly rate, calculated as Hourly rate of the basic wage x 150 percent x 130 percent x number of hours worked.
Ninoy Aquino Day is an annual nationwide observance on August 21, commemorating the assassination of former Senator Benigno "Ninoy" Aquino Jr.
