Comelec Reverses Suspension, Clears Teodoro for Marikina Congressional Proclamation

Marikina City: The Commission on Elections (Comelec) has lifted the suspension on the proclamation of outgoing Marikina City Mayor Marcelino Teodoro as the winning congressional candidate for the city's first district.

According to Philippines News Agency, in a 38-page resolution promulgated on Wednesday, the Comelec en banc reversed the First Division's ruling, which had suspended Teodoro's proclamation due to alleged material misrepresentation of his address in his certificate of candidacy (COC). The new ruling granted Teodoro's consolidated motions for reconsideration and overturned the resolution canceling his COC.

The poll body stated that the petitioners failed to prove that Teodoro committed material misrepresentation regarding his residency in Barangay San Roque, Marikina's first district. The Comelec noted that the Supreme Court, in Aquino v. Comelec, found nothing wrong with an individual changing residences to run for an elective post, provided there is reasonable certainty of a change of residence for election law purposes for the required period.

The Comelec added that Teodoro is neither a stranger nor a newcomer in Marikina's first district, affirming it as his domicile of origin. The order suspending Teodoro's proclamation, issued by the Commission En Banc on May 12, 2025, has been lifted, and his COC for the Member of the House of Representatives, 1st District, Marikina City, in the May 12, 2025 National and Local Elections, is reinstated.

Two petitions seeking to cancel Teodoro's COC over material misrepresentation were filed, one by his contender for the congressional seat, Senate Minority Leader Aquilino "Koko" Pimentel III. Meanwhile, Comelec Chairperson George Garcia mentioned that Teodoro must wait five days for the ruling to become final and executory before the City Board of Canvassers can proclaim him.

Garcia highlighted that the petitioners have the option to appeal to the Supreme Court within the five-day period. He explained that the City Board of Canvassers (CBOC) is independent and not under the control of Comelec. They have the final say on when they will convene and proclaim the winning candidate. If there is no action from the Supreme Court after five days, Comelec will issue an entry of judgment and a certificate of finality, which will serve as the basis for the CBOC to schedule and perform their duties.
