Private Sector Employers Granted Discretion to Suspend Work During Weather Disturbances

Manila: Private sector employers now have the discretion to suspend work during typhoons, heavy rains, and other weather disturbances as announced by the Department of Labor and Employment (DOLE) on Wednesday. This decision is part of a broader initiative to ensure the safety and health of workers amid adverse weather conditions.

According to Philippines News Agency, Labor Advisory 14, issued on August 19, elaborates on the discretionary power given to companies to halt operations during severe weather. This measure aims to protect employees from potential hazards associated with heavy downpours. The advisory also includes guidelines regarding workers' compensation during such periods.

Employees who report for duty during intense thunderstorms are entitled to full pay, provided they work for at least six hours. For those who manage to work less than the stipulated six hours, pay will be proportional to the actual hours worked. The department encourages employers to offer extra incentives or benefits to those employees who braved the conditions to report for work.

In cases where employees do not work due to weather-related dangers, they will not receive regular pay unless a more favorable company policy, practice, Collective Bargaining Agreement (CBA), or accrued leave credits are applicable. Importantly, workers who choose not to report for duty or refuse work due to perceived imminent danger will not face administrative penalties.
