Manila: The Supreme Court (SC) announced on Wednesday a decision that saw nine justices voting against, five in favor, and one abstaining on the petition filed by Senator Ronald 'Bato' dela Rosa. The plea sought a temporary restraining order (TRO) to block the enforcement of an arrest warrant issued by the International Criminal Court (ICC).

According to Philippines News Agency, the high tribunal emphasized that the decision solely addressed the request for interim relief, specifically the TRO, and not the substantive issues of the case. The court noted that the main case, which involves the arguments presented by both parties, remains unresolved.

Senator Dela Rosa, who led the Philippine National Police during former President Rodrigo Duterte's controversial "Tokhang" anti-drug campaign, filed for a TRO or a status quo ante order. His aim was to prevent his arrest based on any ICC warrant, Interpol red notice, or diffusion notice without a corresponding local court warrant.

The Supreme Court has scheduled the release of the full resolution and the justices' opinions on its website by May 25.

Recently, the Office of the Solicitor General (OSG) implored the SC to dismiss Dela Rosa's petition. The OSG underscored the Philippines' commitment to international law and accountability for wrongdoings. It stated that the law is designed to ensure justice for all, including victims whose voices have gone unheard.

The OSG further argued that Dela Rosa's attempts to evade prosecution demonstrate an intention to avoid justice. They contended that such actions should be viewed as a waiver of his right to present evidence and participate in his defense, as a fugitive from justice forfeits the right to seek court relief.
