Bill Proposes Ban on Government Contracts for Public Officers and Relatives

Manila: Agusan del Norte Lone District Rep. Dale Corvera has introduced House Bill No. 5222, aimed at prohibiting public officers, their relatives, and certain associated individuals from engaging in government contracts. The bill was filed on Tuesday to address rising concerns over corruption and irregularities in infrastructure projects.

According to Philippines News Agency, Corvera highlighted the constitutional principle that "A public office is a public trust," urging public officials to demonstrate integrity, accountability, and transparency in their duties to benefit the Filipino people. This principle, Corvera noted, has been challenged by recent corruption reports, particularly in flood control programs.

Corvera also mentioned that President Ferdinand R. Marcos Jr., in his State of the Nation Address on July 28, acknowledged the severity of corruption and labeled these practices as shameful, pledging to hold those involved accountable.

While existing laws such as Republic Act (RA) 6713, RA 3815, and RA 12009 include conflict of interest and disclosure provisions, Corvera argued that they are insufficient in deterring corruption. He emphasized that these laws depend heavily on self-declaration and post-incident accountability, which create loopholes for public officers to benefit indirectly via relatives or business partners.

The proposed bill aims to fill these gaps by explicitly banning public officials and their relatives, whether related by marriage, blood, or business, from participating in government contracts or procurement activities. Corvera asserted that the measure seeks to restore public trust in government operations and discourage individuals motivated by profit from seeking government employment.

Corvera further stated that the bill is intended to reinforce the principle that public funds should be used for the public good, not for private gain.
