Manila: The Commission on Filipinos Overseas urged an evidence-based review of local succession and property laws to better safeguard the inheritance rights of migrant Filipinos living abroad.
According to Philippines News Agency, the commission stated that Secretary Dante 'Klink' Ang II made this call during a recent meeting with Filipino-American lawyer and retired United States Navy officer Sylvester Lee Salcedo. Salcedo highlighted the increasing legal challenges faced by overseas Filipinos when asserting claims over family properties in the Philippines. Ang emphasized that this initiative aligns with the CFO's mandate to preserve the political, cultural, and economic ties between the Filipino diaspora and their homeland, noting that unresolved inheritance issues weaken migrant Filipinos' long-term economic interests in the country.
Ang stressed the need for a comprehensive, research-driven study on these property concerns, advocating for an evidence-based approach to identify deficiencies in current laws and necessary policy interventions to protect the interests of Filipinos abroad. Salcedo, drawing from his legal experience in the US, suggested establishing a systematic framework, potentially involving new legislation, to streamline the inheritance process for Filipinos stationed overseas. He pointed out that many Filipinos abroad struggle to navigate the Philippine legal system from afar, often resulting in the loss of family assets, which discourages them from maintaining economic and emotional ties to the Philippines.
The proposed review is part of the CFO's broader advocacy for overseas Filipino retirees. Ang mentioned the CFO's active role in the Technical Working Group on Retirement and Reintegration, highlighting that inheritance often serves as the foundation for retirement plans for many Filipinos planning to return home. According to the latest CFO data, there are an estimated 10.7 million Filipinos abroad, with more than half being permanent or long-term migrants within the CFO's constituency.
The CFO's Policy, Planning, and Research Division is expected to lead consultations with legal experts and diaspora leaders to craft policy recommendations for the executive and legislative branches of government. By prioritizing a research-driven strategy, the CFO aims to transform these challenges into a bridge that connects the global Filipino community to the Philippine soil and ensure inheritance rights of overseas Filipinos are protected across generations.
